What Is a Power of Attorney and Why Does It Require Translation?
A power of attorney is an official document that authorises a person to carry out certain legal or commercial transactions on behalf of another person. For transactions involving foreign nationals or persons residing abroad, the power of attorney must be translated into both the language of the country where it was drawn up and the country where it will be used.
Drawing Up a Power of Attorney in Turkey
A power of attorney drawn up before a notary in Turkey is prepared with a sworn interpreter if the foreign national does not speak Turkish. The interpreter both translates the document and certifies that the foreign national understands.
Power of Attorney Drawn Up Abroad
If a power of attorney drawn up abroad is to be used in Turkey, the following steps are followed:
- Notary approval in the foreign country: The power of attorney is approved by the local notary.
- Apostille: Sufficient for countries party to the Hague Convention.
- Sworn Turkish translation: The document is translated by a sworn translator in Turkey.
- Notary certification (if required): Some institutions may additionally require the translation to be notarised.
