How to Hire a Court Interpreter? A Legal Guide for Foreign Nationals
Comprehensive information on the right to an interpreter for foreign nationals who do not speak Turkish in Turkish courts, the process, and how to obtain this service in Antalya.
The Right to an Interpreter for Foreign Nationals
Under the Turkish Code of Criminal Procedure and the Civil Procedure Law, defendants, witnesses, or parties who do not speak Turkish have the right to an interpreter in court. This right is an inseparable part of the principle of a fair trial.
Who Can Be a Court Interpreter?
Interpreters appointed by the court are sworn translators registered in the expert witness list within the courthouse. However, parties may also bring their own interpreters and submit them for the court's approval.
How Does the Process Work?
Pre-Trial Preparation
Before the hearing, determine translation requirements together with your attorney. Written documents of the case, such as petitions, decisions, and minutes, must also be translated separately.
Interpretation at the Hearing
Oral interpretation (simultaneous or consecutive) takes place in the courtroom. The interpreter conveys the judge's questions and the parties' statements reciprocally.
Minutes Translation
The official minutes prepared after the hearing may also need to be translated and signed.
Most Common Languages in Antalya Courts
Due to Antalya's cosmopolitan structure, Russian, German, English, Arabic, and Ukrainian are among the languages most frequently requested for interpretation.
Important Points to Note
- The interpreter's impartiality is essential; a family member or friend may not be accepted as an interpreter.
- Persons who are not familiar with technical legal terminology can cause serious communication errors in court.
- In urgent situations (detention, arrest), it is also recommended to notify your Consulate.
